1. Introduction
These Terms and Conditions ('Terms') govern your use of the website www.mokacigar.com (the 'Website') and the purchase of products from MokaCigar ('we', 'us', 'our'). By accessing the Website or placing an order, you agree to be bound by these Terms. Please read them carefully before proceeding.
We reserve the right to amend these Terms at any time. Changes will be effective upon posting to the Website. Your continued use following any amendments constitutes acceptance of the revised Terms.
2. Age Restriction & Eligibility
The sale of tobacco and cigar products is restricted by law to persons aged 18 years or over in the United Kingdom. By placing an order or accessing the Website, you confirm that:
You are at least 18 years of age
You are accessing the Website from a jurisdiction in which viewing and/or purchasing cigar and tobacco products is lawful
You are not accessing the Website on behalf of a minor
We reserve the right to request proof of age at any stage and to cancel or refuse any order where age cannot be verified to our satisfaction. Delivery may be withheld pending age verification.
3. Account Registration
You may browse the Website without registering. To place an order, you may be required to create an account or check out as a guest. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify us immediately of any unauthorised use of your account at support@mokacigar.com.
We reserve the right to terminate accounts, refuse service, or cancel orders at our sole discretion, including where we believe Terms have been violated.
4. Products & Descriptions
We take care to ensure all product descriptions, photography, tasting notes, and specifications are as accurate as possible. However, slight variations may occur in appearance, packaging, band design, or presentation — particularly with aged, vintage, or limited-edition cigars. Product images are illustrative and for guidance only.
All cigars are sold as luxury tobacco products for adult consumers. We make no medical or health claims in relation to any product.
We reserve the right to withdraw any product from the Website at any time without notice.
5. Pricing & Payment
All prices displayed on the Website are in pounds sterling (GBP) and are inclusive of applicable VAT unless otherwise stated. Prices are correct at the time of display but are subject to change. We reserve the right to correct pricing errors at any time.
In the event of a pricing error, we will notify you as soon as practicable. You will not be obligated to proceed with the purchase at the incorrect price.
We accept payment by major debit and credit cards (Visa, Mastercard, American Express) and other methods as displayed at checkout. Payment is processed securely via our payment provider. We do not store full card details. All transactions are subject to authorisation and fraud screening.
Payment is taken at the time of order placement. Your order is not confirmed until payment has been successfully processed.
6. Order Process & Contract Formation
Placing an order constitutes an offer to purchase products from us. A legally binding contract is formed when we send you an order confirmation email. We reserve the right to decline any order for any reason, including but not limited to: product unavailability, payment failure, suspected fraudulent activity, or inability to verify age.
If we are unable to fulfil your order in full, we will contact you to offer alternatives including substitution, partial delivery, or a full refund.
7. Availability & Stock
Product availability is indicated on the Website but cannot be guaranteed. Many cigars we carry — particularly limited editions, regional editions, and aged vintages — are available in finite quantities. Where a product is out of stock after your order has been placed, we will notify you promptly and offer a full refund, an alternative product of equivalent value, or a back-order waitlist arrangement.
8. Cancellations & Your Right to Cancel
Under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, you have the right to cancel your order within 14 days of receiving your goods, without giving a reason ('cooling-off period'), subject to the following exceptions:
Products that have been opened, used, or have had their tamper-evident seal broken
Products that may deteriorate or expire rapidly
Personalised or custom-rolled cigars
Products purchased as part of a sealed bundle or gift set that has been opened
To exercise your right to cancel, you must notify us clearly in writing (email: support@mokacigar.com) within 14 days of receipt. You must then return the goods within 14 days of that notification. Return shipping costs are your responsibility unless the item is faulty or incorrectly sent.
Refunds for valid cancellations will be issued within 14 days of our receiving the returned goods, or proof of return, using the same payment method as the original transaction.
9. Faulty, Damaged & Incorrect Items
If your order arrives damaged, faulty, or incorrect, please notify us within 48 hours of receipt with photographic evidence where possible. We will arrange a replacement, exchange, or full refund as appropriate. Claims made after 48 hours may be assessed at our discretion.
Your statutory rights as a consumer under the Consumer Rights Act 2015 are not affected by these Terms.
10. Intellectual Property
All content on the Website — including text, photography, brand assets, tasting notes, design, and layout — is the intellectual property of MokaCigar or its licensors and is protected by copyright and other applicable laws. You may not reproduce, distribute, modify, or use any content from the Website for commercial purposes without our prior written consent.
11. Prohibited Use
You agree not to use the Website for any of the following:
Purchasing products with intent to resell commercially without our written authorisation
Any fraudulent, illegal, or unlawful purpose
Transmitting any unsolicited marketing, spam, or harmful content
Attempting to gain unauthorised access to any part of the Website or its systems
Using automated tools to scrape, monitor, or copy Website content
Impersonating any person or entity or misrepresenting your identity
12. Limitation of Liability
To the fullest extent permitted by law, MokaCigar shall not be liable for any indirect, incidental, consequential, or punitive damages arising from your use of the Website or purchase of products, including but not limited to: loss of revenue, loss of profits, loss of data, or loss of enjoyment.
Our total liability for any claim arising from your purchase shall not exceed the total value of the order in question.
Nothing in these Terms limits our liability for death or personal injury caused by our negligence, fraud, or fraudulent misrepresentation, or any liability that cannot be excluded under applicable law.
13. Third-Party Links
The Website may contain links to third-party websites for informational purposes. We are not responsible for the content, accuracy, or privacy practices of any third-party site. Visiting such links is at your own risk.
14. Force Majeure
We shall not be liable for any failure or delay in performing our obligations caused by circumstances beyond our reasonable control, including but not limited to: acts of God, natural disasters, pandemic, strikes, government action, customs delays, or carrier failures. We will notify you of such circumstances as soon as reasonably practicable.
15. Governing Law & Disputes
These Terms are governed by and construed in accordance with the laws of England and Wales. Any disputes arising from these Terms or your use of the Website shall be subject to the exclusive jurisdiction of the courts of England and Wales.
We are committed to resolving disputes amicably. If you have a complaint, please contact us at support@mokacigar.com in the first instance. We aim to respond within 5 business days.
